1. Introduction

Welcome to FreshieBOT.

These Terms of Service (“Terms”) govern your access to and use of FreshieBOT, including our Discord bot, website, dashboard, subscription plans, and any related products or services (collectively, the “Services”).

In these Terms, “FreshieBOT”, “we”, “us”, and “our” refer to the operator of FreshieBOT. “You” and “your” refer to any individual or organisation accessing or using our Services.

By accessing or using FreshieBOT, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, you must stop using the Services.

We may update these Terms from time to time. When changes are made, we will update the “Last updated” date above and may provide additional notice where appropriate or required by law. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms, where legally permitted.

You must be at least 18 years old to purchase a subscription or enter into a legally binding agreement with us. Users under 18 may only use the Services where permitted by applicable law and with any required parental or guardian consent.

2. Our Services

FreshieBOT is a Discord bot and related platform designed to support DayZ gaming communities and server administrators.

Depending on the features available, the Services may include:

• Discord server management and administration tools.
• Player information and server-related utilities.
• Killfeed, event, and gameplay-related features where supported data is available.
• Server configuration and management tools.
• Website access, account registration, and dashboard functionality.
• Premium features and paid subscriptions.
• Additional tools and features introduced in future updates.

The availability and functionality of individual features may depend on your Discord permissions, server configuration, hosting provider, platform, subscription plan, and the data or integrations available to us.

We do not guarantee that every feature will be available at all times or compatible with every DayZ server, hosting provider, console platform, or third-party service.

3. Account Registration and Security

Some features may require you to register for an account or authenticate through a third-party service, such as Discord.

You agree to:

• Provide accurate and up-to-date information when registering.
• Keep your account credentials secure.
• Be responsible for activity conducted through your account.
• Maintain appropriate permissions for any Discord server or external service you connect.
• Notify us promptly if you suspect unauthorised access to your account.
• Avoid sharing your account or dashboard access in a way that compromises security.

You must not impersonate another person, create accounts using false information, or attempt to access another user’s account without permission.

We reserve the right to suspend or terminate accounts that breach these Terms or pose a risk to the Services or other users.

4. Intellectual Property

Unless otherwise stated, FreshieBOT and its licensors own or hold the necessary rights to the Services, including the software, source code, branding, logos, website design, documentation, graphics, and original content.

These materials are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose.

You must not, without our prior written permission or unless permitted by applicable law:

• Copy, reproduce, distribute, or commercially exploit our software or proprietary materials.
• Sell, rent, sublicense, or redistribute access to FreshieBOT.
• Reverse engineer, decompile, or attempt to extract source code, except where applicable law permits.
• Remove copyright notices or branding in a way that infringes our rights.
• Use our branding to misrepresent an affiliation with FreshieBOT.

Any rights not expressly granted to you remain reserved by us.

Feedback and Suggestions

If you voluntarily submit suggestions, ideas, or feedback about FreshieBOT, you grant us permission to use that feedback to improve or develop our Services without compensation, subject to applicable law.

You retain ownership of any intellectual property rights you already hold in your feedback.

5. Acceptable Use

You agree to use FreshieBOT responsibly and only for lawful purposes.

You must not:

• Use the Services for illegal activities, fraud, harassment, threats, or abuse.
• Attempt to gain unauthorised access to our systems, servers, accounts, or infrastructure.
• Exploit bugs, vulnerabilities, or unintended functionality.
• Interfere with the availability, performance, or security of the Services.
• Distribute malware, malicious code, spam, or harmful content through our Services.
• Use unauthorised scripts, automated requests, scraping tools, or other methods to overload or abuse the platform.
• Circumvent subscription restrictions, access controls, or security measures.
• Attempt to bypass payment requirements or obtain premium features without authorisation.
• Resell, redistribute, or share paid features with unauthorised users.
• Use FreshieBOT to collect personal information unlawfully or without the necessary authority.
• Misrepresent your identity or your authority over a Discord server or DayZ community.
• Use the Services to develop or operate a competing service through unauthorised access to our software or proprietary information.
• Abuse our support channels, submit knowingly false reports, or threaten individuals responsible for operating the Services.

We may investigate suspected abuse and take reasonable action to protect FreshieBOT, our users, and our infrastructure.

6. Discord and Third-Party Platform Rules

FreshieBOT may interact with Discord, DayZ, game server hosting providers, payment processors, and other third-party platforms.

You agree to comply with the applicable terms, policies, and rules of any third-party service you use in connection with FreshieBOT, including Discord’s Terms of Service and Community Guidelines.

FreshieBOT is an independent service and is not owned, operated, sponsored, or endorsed by Discord, Bohemia Interactive, or any game server hosting provider unless expressly stated otherwise.

Third-party names, trademarks, and logos remain the property of their respective owners.

We are not responsible for decisions made by third-party platforms, including account restrictions, API changes, service outages, or changes to their terms and policies.

7. DayZ Server Data and Compatibility

FreshieBOT’s ability to provide server information, player statistics, killfeed information, coordinates, events, or other gameplay-related features depends on the data sources and integrations available to us.

We do not guarantee access to every type of game data, particularly where a console platform, server host, game publisher, or third-party provider restricts access.

Some features may require specific server settings, compatible integrations, supported logs, permissions, or third-party services.

You are responsible for ensuring that your use of FreshieBOT and any connected server data complies with applicable laws, hosting provider rules, game publisher policies, and the rights of affected users.

We are not responsible for inaccurate, incomplete, delayed, or unavailable game data resulting from limitations outside our reasonable control.

8. Purchases and Payments

Certain FreshieBOT features may require payment.

Before purchasing, you will be shown the applicable price, subscription period, and other material payment terms.

You agree to provide accurate billing information and pay all charges applicable to your selected plan.

Unless stated otherwise at checkout:

• Prices will be displayed in the applicable currency.
• Payment processing may be handled by a third-party provider.
• Taxes will be charged where required by applicable law.
• We may change prices for future purchases or renewals, subject to applicable notice requirements.
• We may refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, or pricing errors.

Any applicable payment processor terms will also apply to your transaction.

9. Subscriptions and Cancellations

Subscription Billing

If you purchase a recurring subscription, it will automatically renew at the end of each billing period unless you cancel before the renewal date.

By purchasing a recurring subscription, you authorise the applicable payment provider to collect renewal payments in accordance with the subscription terms presented at checkout.

The applicable billing interval, price, and renewal date will be shown when you subscribe.

Cancellation

You may cancel your subscription using the cancellation method provided by the relevant payment provider or through your account dashboard, where available.

Unless otherwise stated, cancellation prevents future renewals but does not automatically provide a refund for the current billing period.

Your access to paid features may continue until the end of the period already paid for, unless termination is necessary for security, abuse, payment disputes, or another legitimate reason.

Refunds

Refund requests will be considered in accordance with applicable consumer protection laws and any refund terms displayed at the time of purchase.

Nothing in these Terms excludes or limits any statutory refund, cancellation, or other consumer rights that cannot lawfully be excluded.

Free Trial, Renewal and Your 14-Day Period

New servers can start a 7-day free trial. We ask for a payment card to start it. If you do not cancel before the trial ends, your subscription continues automatically and the monthly price shown at checkout (currently £5.00 per month, including VAT where it applies) is charged on the date shown to you before you start, and then every month until you cancel. One subscription covers one Discord server and one DayZ server.

You can cancel online at any time from the Billing page of your dashboard. No phone call, email or feedback form is needed. If you cancel, you keep access until the end of the period you have paid for (or the end of the trial) and are not charged again.

When your free trial turns into a paid subscription you have 14 days, starting the day after the first payment, to cancel and ask for a refund. We will email you the dates when the first payment is taken. If you cancel in that period we will refund the part of the period you have not used, or the full payment if you have not used the service, to the card you paid with within 14 days of agreeing the refund. You can ask for a refund from the Billing page. This does not limit any statutory rights you have.

We will also remind you by email before your first payment after a trial and from time to time while a subscription continues. If your payment fails, FreshieBOT may be switched off for your server until it is paid; your settings are kept.

Changes to Subscription Fees

We may change subscription prices from time to time. Where required by law, we will notify you before a price change takes effect and provide an opportunity to cancel before the new price applies.

10. DayZ Server Monetisation

If you use FreshieBOT in connection with a DayZ community, server, or monetised gaming project, you are responsible for ensuring that your activities comply with the applicable rules of Bohemia Interactive and any relevant hosting provider or platform.

You must not use FreshieBOT to facilitate prohibited sales, unauthorised monetisation, or activities that violate applicable game publisher policies.

FreshieBOT does not guarantee that your server, community, or monetisation model will be approved by a game publisher or third-party platform.

Any action taken by a game publisher or hosting provider concerning your server or community remains outside our control.

11. Service Availability and Maintenance

We aim to keep FreshieBOT available and functioning reliably. However, we do not guarantee uninterrupted access or that every feature will operate without errors.

The Services may be temporarily unavailable due to:

• Scheduled or emergency maintenance.
• Software updates, deployments, or technical changes.
• Hosting, network, or infrastructure failures.
• Discord API limitations or outages.
• DayZ server or hosting provider issues.
• Security incidents or events outside our reasonable control.

We may add, modify, suspend, or discontinue features where reasonably necessary to maintain, improve, or protect the Services.

Where reasonably practicable, we will provide notice of significant planned changes. Nothing in this section removes any legal obligations we owe to consumers.

12. Third-Party Services and Links

The Services may contain links to third-party websites, tools, integrations, or payment providers.

These services are operated independently of FreshieBOT and may have their own terms, privacy policies, fees, and availability requirements.

We do not control third-party services and are not responsible for their content, policies, security, or performance, except to the extent responsibility cannot lawfully be excluded.

You access and use third-party services at your own discretion and should review their applicable terms before using them.

13. Privacy and Data Protection

We may process information necessary to operate FreshieBOT, including account details, Discord identifiers, server configuration information, subscription status, technical logs, and information generated through the features you use.

The information collected and how it is used will depend on the Services you access and the permissions or integrations you enable.

We will handle personal data in accordance with applicable data protection law, including UK data protection legislation where applicable.

14. Suspension and Termination

We may suspend, restrict, or terminate access to FreshieBOT where reasonably necessary, including where:

• You materially breach these Terms.
• Your use creates a security risk or threatens the stability of the Services.
• You engage in fraud, abuse, or unauthorised access.
• A third-party platform requires or causes access to be restricted.
• We are legally required to do so.
• We discontinue the relevant Services.

Where appropriate and practicable, we may provide notice and an opportunity to resolve the issue. Immediate action may be necessary in cases involving serious abuse, security threats, or legal requirements.

If your account is terminated, your permission to use the affected Services will end.

Any effect on subscriptions, outstanding payments, refunds, and access to paid features will be handled in accordance with the applicable purchase terms and consumer law.

Termination does not affect rights or obligations that have already accrued or provisions that are intended to survive termination.

15. Disclaimers

To the fullest extent permitted by law, FreshieBOT is provided on an “as available” basis.

We do not guarantee that the Services will always be accurate, uninterrupted, error-free, compatible with every system, or available indefinitely.

We do not guarantee specific gameplay results, server performance, player activity, revenue, or the availability of information supplied by third parties.

Nothing in these Terms excludes any warranty, statutory protection, or consumer right that cannot lawfully be excluded under applicable law.

16. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where such exclusion is prohibited by law.

Subject to the foregoing, and to the fullest extent permitted by applicable law, we will not be liable for indirect or consequential losses that were not reasonably foreseeable, including loss of anticipated profits, business opportunities, goodwill, or data.

We are not responsible for interruptions or failures caused by third-party platforms, hosting providers, game server operators, network providers, or circumstances outside our reasonable control, except where applicable law requires otherwise.

Where you use the Services as a consumer, nothing in this section affects your mandatory statutory rights.

17. Indemnification

To the extent permitted by applicable law, you are responsible for losses, claims, and reasonable expenses arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights.

Nothing in this section requires you to indemnify us for losses caused by our own negligence, breach of legal obligations, or other conduct for which responsibility cannot lawfully be transferred to you.

18. Data Backups and Data Loss

We take reasonable steps to maintain the information needed to operate the Services and may use routine backups where appropriate.

However, we cannot guarantee that all data will always be retained or recoverable.

You should retain your own copies of any important information or configurations where the Services permit you to do so.

We will handle any loss of personal data in accordance with our legal obligations. Nothing in this section excludes liability where it cannot lawfully be excluded.

19. Changes to These Terms

We may revise these Terms to reflect changes to our Services, business operations, security requirements, or legal obligations.

The revised Terms will be published with an updated revision date. Where required by law, we will provide notice of material changes and obtain any necessary consent.

You should periodically review these Terms to remain informed of the conditions governing your use of FreshieBOT.

20. Governing Law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protection laws that apply to you.

If you are a consumer residing in another jurisdiction, you may retain the benefit of mandatory protections provided by the laws of your country of residence.

Disputes will be subject to the jurisdiction of the courts of England and Wales where legally appropriate, without restricting any consumer rights to bring proceedings in another court where applicable law permits.

21. Corrections

We may correct errors, omissions, outdated information, and inaccuracies in our website, dashboard, documentation, pricing information, or other published materials.

Where a correction materially affects a purchase or an existing contractual commitment, we will address it in accordance with applicable law.

22. General Provisions

These Terms, together with our Privacy Policy and any additional terms presented for particular Services or purchases, form the agreement governing your use of FreshieBOT.

If any provision is found to be unlawful or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision does not constitute a waiver of our rights.

We may transfer our rights or obligations in connection with the Services where legally permitted, provided that doing so does not unlawfully prejudice your rights.

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, subject to applicable law.

Nothing in these Terms creates a partnership, employment relationship, or agency relationship between you and FreshieBOT.
